Medtronic accepts terms of preliminary injunction

Medtronic has accepted the terms of an order that mean a company will not be able to use misleading marketing claims related to its Kyphon Balloon Kyphoplasty.

On May 19th, the German competition court granted the company a preliminary injunction against DFine Europe.

As part of the order, the firm is to no longer use certain promotional claims that compare its bone StabiliT ER2 to Medtronic’s KyphX HV-R Bone Cement.

DFine Europe has also agreed to the terms.

Under German law, a preliminary injunction is given as an action against anti-competitive behaviour, which includes illegal advertising.

Meanwhile, the Food and Drug administration has granted Physio-Control ? a wholly-owned subsidiary of Medtronic – marketing clearance for its next-generation Lucas Chest Compression.

The device is an automated item that gives consistent treatment to victims in cardiac arrest, without any interruptions.

President of Physio-Control Brian Webster said the product was in response to customers who had been asking for a battery-operated version of the Lucas over the last couple of years.
