| Proctor and Gamble patent lawsuit reaches settlement | Posted on 07/01/2009 in Pharmaceutical Company Product News Proctor & Gamble (P&G) has reached a settlement on a lawsuit it filed regarding alleged patent infringement, it has been confirmed.
Previously it had been suggested Fruit of the Earth, a firm that produces a range of skin and healthcare products, had breached rules relating to the formula of P&G's Olay Regenerist product.
The suit, which was put forward by the pharmaceutical company on December 12th 2007, has now been settled via a consent judgment - which states Fruit of the Earth must recognise the validity of the original claim.
It will also mean existing Fruit of the Earth products considered to infringe the Olay Regenerist brand will now be revised - with the remaining terms of the agreement to be left undisclosed.
Commenting on the decision, P&G's chief legal officer Steve Jemison said the firm had defended its product in this way to ensure those who buy the Olay Regenerist are aware of its exclusivity.
"P&G will continue to vigorously protect our proprietary formulas and the trade dress that consumers associate with the brands they trust," he added.
Fruit of the Earth is a US-based firm that specialises in skincare products that use aloe vera as a key ingredient.
