| Wyeth hormone therapy lawsuits dismissed | Posted on 15/07/2008 in Pharmaceutical Company Product News Wyeth has announced that two hormone therapy lawsuits filed against the company have been dismissed.
The company's motion for a summary judgement in the two cases scheduled for trial later this year were granted by Judge Jamie D Happas of the New Jersey Superior Court in New Brunswick.
Both the case of Bailey v Wyeth due to begin on September 15th 2008 and DeBoard v Wyeth set to start on October 27th 2008 were dismissed by the judge.
The plaintiffs in both cases alleged they had developed breast cancer after using Prempro and Premairin hormone therapy products from Wyeth and Provera from Upjohn.
Judge Happas ruled the plaintiffs had not provided the necessary specific evidence to overcome the presumed adequacy given to US Food and Drug Administration-approved labelling.
Lauren E Handler, a partner with Porzio Bromberg & Newman, a New Jersey-based firm representing Wyeth in both cases, said: "We believe the court's ruling was a proper application of New Jersey law."
She added that the decision was consistent with a growing body of law that rejects challenges to labelling that has been approved by the regulators.
Last week, Wyeth announced its motion for judgement on a matter of law regarding punitive damages in Arkansas had been granted by the court.Other news stories from 15/07/2008
