Gyrus settles patent dispute

Gyrus, the British medical devices manufacturer, and Medtronic have agreed to settle a lawsuit concerning patents for a micro-debrider system.

Medtronic Xomed, a subsidiary of Medtronic, sued Gyrus two years ago, alleging that its patents were infringed in Gyrus’ Diego micro-debrider system. Gyrus, in response, filed counterclaims against Medtronic, but both companies have now agreed to settle and are dismissing their respective claims.

Under the terms of the agreement, neither Gyrus or Medtronic will sue each other in future regarding to patents for their micro-debrider products, while neither company will pay any damages or payments for patent breaches.

Both companies have agreed to pay their own legal costs.

In July, Gyrus announced a pre-close financial statement for the first six months of 2006. Revenue growth increased by more than 125 per cent in the space of a year while reorganising the business.

Brian Steer, executive chairman of Gyrus, commented: “The first half of 2006 has been a successful period of change; we have made significant inroads into the integration programme and have started to re-orientate the legacy ACMI business towards our disposable devices business model.”
